Yeah, I agree. You need to be more careful drinking the higher ABV beers.

Still, at least based on the BAC calculators out there, 0.10 is not "borderline" for driving. You have no business behind the wheel at that level, and I'm fine with draconian penalties for people who recklessly choose to endanger the lives of those around them. You just can't sweep up the casual drinker who had that one extra glass at wine with dinner in the draconian penalties or you'll never be able to enforce it.

Edit: I did just google "BAC limits by state" and it appears every state is at 0.08, but numerous states have "enhanced penalty BAC levels" -- mostly 0.15. So maybe to amend my original post you go with 0.08 - 0.14 is standard DUI while 0.15+ is enhanced DUI with penalties like RML outlines -- immediate, and significant jail time and forfeiture of vehicle, major fines, etc.
